“Have been” means how things ‘have been’ recently, like over a period of time (such as in the last month, year, few years, etc) that you are currently still a part of
Ex. Maybe over the last year the city has been seeing more and more crimes, and no one is sure why. The mayor might say, “as we all know, crime has been increasing this past year, so I, along with the police, am launching an investigation into it.
The second sentence is just a statement of fact about something that has happened. Crimes have increased.
Ex. Maybe last month there were 50 crimes, and this month there were 60. So, you can conclude that some new law didn’t work.
